No, the tour shall probably go on. But I think that Jarre his contract with EMI will be broken. It is a kind of fraude here what Jarre did. There is even a chance (in the worst scenario) that Jarre must go to jail.
Very stupid of Jarre to do this.

Yes, I see now VCS3 or SYNTHI sounds as Analogue-umph says.
There will also be some additional processing on those in Equinoxe 4 sounds as Jarre's attempt to replicate live during the China concerts sounded nothing like the original

Nah I don't really think that's the case. I have never heard about people going to jail for stuff like this.

So far it seems that Dreyfus doesn't have the rights to the notes and sounds, just the original recordings. It would be pretty hard to make music, if people started to put copyright on saw and square waves.

Anyhow I think that the old and dusty music copyright laws belongs to the 1900 century.
Just look at all the hit makers stealing music from each other like nothing.

I might have been unclear in my previous post. To make it simple:
The master tapes usually aren't intended as all the recorded material.
Normally the master tapes are intended only as the final stereo mix tape.
The multitrack tapes are tapes which contain the separate recording of the individual instruments.
From what I've read here it seems that Dreyfus owns the rights on the 1976 master tape (I mean the stereo mix tape).
So, to my point of view, it dipends on who owns the rights of the multitrack tapes.
Who owns these rights may re-record, re-mix and create different versions of the recorded material without affecting the rights of the mix master tape owner.

What about the recent live DVDs: China and Gdansk, or Aero, all of which have tracks which were once released on the Dreyfus label. I haven't heard anything about a lawsuit because of that. JMJ is entitled to play his own music, not to use the original masters, that's my guess, at least.

hmm... I don't know what your knowledge is of rights, but on fraude there is always a possibility of jail. Counterfeiting are no peanuts. There are many people in jail for stuff like that.

The rights had been paid on this. Don't forget, if an artist sign a contract, than is the owner of the music the record company. And they decide (the record-company) what happened with the music. I think that is normal because they have invest a lot of money on the artist(they paid for dubplates, pressing factory, advertising, distribute the product,...). That is with any artist. That is how record-company's work, and it is normal. An artist without a label means nothing in the music industry.

Hi,
First, digital instruments can mime to "go out of tune and waveform" warmth these days, as randomly as analog and no one can tell the difference.
Second, everything sounding exactly as it does in 1976 Oxygene belongs to Dreyffus, and if played or copied, must pay them rights (soundtrack and mechanical), and pay Jarre authorship rights.
If Jarre commited fraud to EMI, he only risks a broken contract for putting at risk the company reputation for lying, unless money is involved, where then he may face a criminal charge for damaging someone else's property, which is partly, a public crime, hence, serious - he has not stolen anything, but fraud goes down the same way if you get depicted of your money for nothing.
But it's not what I see here. Neither fraud nor good faith, but the same "gamble" as in T&T, easy money, little work, perhaps won't be noticed... but it's taking away Dreyffus last source of real money... Jarre's early work.
Third, concerts should go ahead, for commercial reasons, and Jarre needs the money, in case he looses... although I do believe it won't be under EMI... but someone needs that recorded for DVD purposes... who will own the rights?
Jarre stretched the rope too damn much and it broke, he is now sailing away... the only thing that may save him is favourable currents.

So it seems, Jarre is taking very much "for granted" - or in another most unlikely scenario he wanted this to happen all along, but I very much doubt that.
After so many years in the business he really should have known this was going to happen.
If he wants to use the old masters the only way out is to pay a rediculous amounts of money for something that he once created or recreate a different composition.
Perhaps there was something strange going on in Jarre's studio during the recording of this remarkable CD? More information is needed.

With the ticket prices fresh in mind I have no doubt there will be some kind of tour.

Yeah, first of all Jarre does not have to decide in the court. And THERE IS a huge amount of money involved. Such practices are fraud. No discussion! And a sentence will get. Because he has frauded. And the sounds, instruments, or whatever he used is bullshit. It is all about the rights of the music(THE NOTES). And not about the sounds, instruments, or any other shit.
